Leave must first be granted before a document can be filed under seal. IMPORTANT: Once leave has been granted to file a document under seal, counsel will be responsible for following up by filing the sealed document.
The filing party is responsible for serving this motion and all attachments to opposing counsel through means outside of CM/ECF
INSTRUCTIONS FOR FILING A MOTION FOR LEAVE TO FILE SEAL DOCUMENT(S):
The following steps are for filing the initial motion asking for leave to file under seal. Counsel has two locations from which to select the civil Motion to Seal Document(s) - Leave to File event: 1) from the Civil->Motions link or 2) Civil->Sealed Documents (in Public Cases) link. The criminal Motion to Seal Document(s) - Leave to File event can be selected from: 1) the Criminal->Motions link or 2) Criminal->Sealed Documents (in Public Cases) link.
Select the event Seal Documents(s) - Leave to File and click the Next button.
Add your case number and select Find This Case. If filing in a criminal case, you may need to indicate the defendant case where this motion will be filed. Click Next.
Civil Criminal
If the hyperlink contains the correct case style, select Next to continue. If not, stop your filing and determine the correct case number.
Select the filer. If you need to select multiple names, hold down the CTRL key while selecting. After proper selection, select Next.
Add the pdf file of the main document (THIS IS YOUR MOTION REQUESTING LEAVE TO FILE UNDER SEAL). Add the pdf files and properly describe each attachment. ***The document you want to file under seal should be an attachment to the motion*** When finished uploading, select Next.
