New Disclosure Requirements Effective December 1, 2022

Effective December 1, 2022, Federal Rule of Civil Procedure 7.1 will be amended to add the requirement that parties or intervenors in diversity cases must file a disclosure statement naming, and identifying the citizenship of, “every individual or entity whose citizenship is attributed to that party or intervenor.” This is to be submitted when “the action is filed in or removed to federal court,” or with the “first appearance, pleading, petition, motion, response or other request address to the court.” Additionally, Fed. R. Civ. P. 7.1 will be amended to clarify that a nongovernmental corporate “intervenor” also must file a corporate disclosure statement.
